Delium Efficiency
The Challenge
A multi-party dispute with 17 legal practitioners at the bar table. The litigators, Counsel and Judge had no previous eTrial experience. Delium does not require specialist hardware on the bar tables so each party was able to provide their own standard PC workstations and laptops as required to minimise costs. Improved access to the evidence for parties and the Judge. The judge commented he thought the use of Delium had “accelerated the proceedings”.
The parties were very cost conscious and determined to reduce traditional eTrial costs (which they perceived to be expensive) without diminishing the functionality and support they required. The original estimate of 3,000 documents blew out to 5,000+ documents and 100,000 pages comprising of 69 discrete imports during the trial.
Delium Strategy
Delium does not require specialist hardware on the bar tables so each party was able to provide their own standard PC workstations and laptops as required to minimise costs.
Out of court, practitioners would, use Delium to prepare witness examination or submission bundles and sequence the evidence in the order they intended it to be presented. In Court, from the commencement of hearings, the same practitioners took full operational control of the hearings and would publish documents sequentially into evidence as their Counsel progressed through examinations or submissions. Placing this functionality back in the hands of the legal practitioners removed the need, and associated cost, for a dedicated Court Operator. It allowed proceedings to flow more smoothly as the supporting legal practitioners worked at the pace set by Counsel. The legal practitioners could publish the next document before Counsel referred to it so Counsel could judge a witness’s reaction to the document in front of them or they could wait so Counsel could gauge the witness’s anticipation at what was to come as Counsel set the scene.
The Benefit
Improved access to the evidence for parties and the Judge. The judge commented he thought the use of Delium had “accelerated the proceedings by at least 50%, probably significantly more.”
Delium cost the parties approximately $250NZD per day totalling $115,000. Estimating only legal practitioner fees at $50,000 per hearing day, the 50% reduction in hearing days delivered by Delium saved the parties $7.9 million dollars – a cost benefit of 69:1.
There were also substantial cost savings as a result of a reduction in photocopying and incidental expenses. Removed cost of dedicated operator. During the course of the trial, a total of 12,658 publications were effected without specialist technical or operational intervention.
