From Sceptic to Advocate
A self-proclaimed technophobe Judge quickly embraced Delium’s intuitive eTrial system, taking control of evidence management and actively advocating for its efficiency.
The Challenge
A billion-dollar litigation involving thousands of documents and globally dispersed legal teams had been progressing for more than six years. With trial set to run for two years, an eTrial was ordered to ensure efficiency.
However, just weeks before the trial began, the presiding Judge recused himself, and a replacement Judge took over—one who described himself as technologically inept. While he agreed to continue with the eTrial, he was concerned that technology should serve the court, not dominate it.
This raised a key challenge: How could Delium support a technophobic Judge, ensuring seamless courtroom operations while allowing him to focus on the trial?
Delium Strategy
To accommodate the Judge’s reservations, Delium was introduced with a simple, intuitive setup:
- The Judge was provided with two monitors – one displaying what the witness saw, and the other controlled by his Associate.
- The keyboard and mouse were placed at the farthest end of the bench, ensuring the Judge could observe without direct interaction.
However, Delium’s ease of use quickly won him over. Within days, the Judge moved the keyboard and mouse closer to him and began actively navigating Delium himself – reviewing documents, annotating evidence, and conducting independent searches in his Private Case.
To further streamline courtroom efficiency, Delium provided:
- Hyperlinked transcripts, allowing instant access to referenced exhibits.
- Integrated messaging, enabling seamless communication between the Judge, Associate, and Operator.
- 24/7 remote access, allowing the Judge to work from Chambers as needed.
- Quick access to pleadings, court rules, legislation, and Aide Memoires, eliminating the need for separate systems.
Over the course of the six-month trial, the Judge fully embraced Delium, going from hesitant observer to an active user who championed its efficiency. He even began scolding Counsel who relied on hard copy documents, noting the delays this caused.
The Benefits
- Judge-led eTrial adoption – Despite initial skepticism, the Judge became a proactive Delium user, proving its intuitive and user-friendly design.
- Faster courtroom processes – Real-time access to evidence and instant searches eliminated delays caused by paper-based processes.
- Seamless evidence management – The Judge independently retrieved documents, made annotations, and navigated evidence effortlessly.
- Greater efficiency for all participants – Integrated case materials, transcripts, and messaging ensured smooth trial progression without disruptions.
Reflections from Participants
Although initially skeptical, the Judge quickly adapted to using Delium and later shared his experiences of its efficiency, reliability and ease of use in a paper for the State Archives:
- “Rather than rely on my Associate, I soon found that Delium had been developed to such a high standard of user-friendliness that its use did not detract from my concentration on the trial.”
- “Delium ran extremely smoothly and efficiently without interruption.”
- “Delium was a pleasure to use. I found that I was doing my own searches and retrieving information without delay, difficulty, or interruption to the conduct of the trial. On some occasions, I even began to feel frustrated when Counsel, relying on hard copy documents, were causing minor delays.”
- “Delium provides new horizons, not only of efficiency but of availability and quality of information.”
- “The speed of access to obscure passages by simple and efficient search processes saved enormous time in retrieval. The text was presented in a form that was easy to read, as indeed were the documents and the data relating to them.”
What began as a reluctant eTrial adoption transformed into a powerful demonstration of Delium’s user-friendly efficiency. By the end of the trial, the Judge actively championed Delium, proving that even those hesitant about technology can quickly recognise its value when the right system is in place.
