Evidence Management & Presentation
Delium’s acclaimed evidence presentation environment is changing the face of trials and arbitrations globally. With Delium, evidence presentation technology is advanced from an essentially passive screen-share display to an interactive environment servicing participants’ individual needs, roles, and obligations.
- Delium comprehensively supports the roles of all hearing participants, understanding the relationships within teams and between them.
- Delium reinstates the interactivity of a traditional courtroom.
- Delium supports participants working seamlessly with public data and private evidence analysis during hearings, independently viewing pre-hearing analysis and recording further observations during proceedings.
- Delium restores attorney control over the evidence.
- Delium automatically generates a comprehensive record of proceedings.
Delium’s patented presentation functionality makes it the only etrial and arbitration solution capable of providing a genuinely paperless electronic courtroom run by legal teams. Delium replicates the best elements of the traditional trial processes and workflows. You can have everything you need at trial loaded and available in Delium:
- Evidence
- Procedural Documents
- Witness Statements
- Transcript
- Pleadings
- Orders and Rulings
- Notices/Filings
- Cited Cases
- Counsel’s Notes
- Demonstrative Aids
- Aide Memoirs and
- Submissions.
Evidence Publication
Delium’s flexible approach restores the traditional ability of legal team members to control the flow of their evidence presentation to other trial participants. Published evidence can be presented open to a specific page, zoomed in to a region, or with highlighted portions. However, Delium delivers a significant advantage to participants once evidence is published. Having received the published evidence, participants can work with the entire document independently of other participants, just as they would if handed a complete paper copy.
Delium supports publishing evidence:
- publicly to the screens of all trial participants
- privately to the screens of a sub-section of the trial participants, like the Judge and opposing Counsel during a voir-dere argument, or
- privately to the screen of a member of your legal team to check the validity of a document.
- Alternatively, an independent 3rd party operator can drive the process on behalf of the legal teams
Private Evidence
Every participant in a hearing comes with a unique perspective and understanding of the evidence to be presented. However, first and second-generation evidence presentation technology, such as slave screen or share screen tools, delivers a genericized experience that does not support traditional workflows or the participants’ requirement for ongoing analysis.
The flexible approach of Delium restores the traditional ability of legal team members and the judiciary by simultaneously displaying the evidence and publicly available meta-data alongside any private analysis or notes a participant has prepared in the lead up to hearings. This removes the requirement for them to independently search for and retrieve private analysis as a witness is being examined. Further private analysis and notes can also be added during hearings. This analysis can be private to the user or shared between members of a legal team.
The Whole Document in Your Hands
First-generation evidence presentation technologies easily and speedily display ‘callouts’ of the relevant parts of a particular document. However, this presentation style fails to efficiently present the whole document in the context of the specific passage displayed. As a result, without individual and duplicative efforts to read and understand the entire document, trial participants may fail to comprehend the true significance of the callout, particularly a witness.
While Delium supports callouts and zooming to a particular document portion, importantly, Delium publication still puts the whole document in a trial participant’s hands. Delium supports a trial participant’s ability to independently page forward and back, zoom, rotate, compare, annotate and analyse the whole document, not just a presented passage.
View Evidence Your Way
Delium supports publishing evidence:
- publicly to the screens of all trial participants
- privately to the screens of a sub-section of the trial participants, like the Judge and opposing Counsel during a voir-dere argument, or
- privately to the screen of a member of your legal team to check the validity of a document.
Published evidence can be presented open to a specific page, zoomed in to a region, or with highlighted portions. However, Delium delivers a significant advantage to participants once evidence is published.
Having received the published evidence, each participant can work with the entire document independently of other participants, just as they would if handed a complete paper copy.
- Published View – view exactly as the witness is viewing the evidence
- Published/Private View – simultaneously view your Private copy of the evidence with you analysis
- Side By Side View – two published documents side by side for comparison
Tie Preparation to Presentation
Delium
seamlessly supports access to legal teams’ pre-hearing analysis and work
product, including comments and annotations.
Legal teams can prepare cross-examination notes and lists of documents for presentation to witnesses,
complete with markup and call-outs identified.
By preparing in Delium, legal teams can have full confidence that the evidence they intend to call has been
uploaded and is available ahead of witness examination.
The Judge or Arbitrators Perspective
In a traditional trial or arbitration, Judges and Arbitrators are not usually provided with access to a system to specifically record their trial analysis. Instead, they must rely on a range of private and disparate systems. In a Delium eTrial, the Judge or Arbitrator and their team have access to the same features as the legal practitioners. However, for the Judge or Arbitrator, there are additional benefits.
Delium automatically creates a comprehensive evidence management record as a by-product of using Delium in the Trial. This automated record greatly enhances the Judge or Arbitrators capacity to review the Trial’s or Arbitration’s events when formulating judgment or arbitral determination.
This comprehensive evidence management record includes:
- A comprehensive list of the evidence presented to a witness, including the Document ID and exact focus point within a page, including any zooming or highlighting.
- Who presented the evidence to the witness, including the date and exact time.
- A list of all participants who simultaneously viewed the evidence shown to the witness.
- A comprehensive Exhibit list.
- Transcript automatically linked to the exhibits which can be viewed and read side by side.
Delium provides an extended capacity to manage the status of evidence, with the ability to record objections and apply limits to the admission of exhibits, both by category and with a narrative.
The Judge or Arbitrator can interact with the legal practitioners and the evidence replicating the controls and processes of evidence presentation in face-to-face trials or arbitrations as follows:
- Documents can be passed directly and privately between practitioners and the Judge or Arbitrator.
- The Judge or Arbitrator can directly communicate requirements to legal practitioners without the imposition of an intermediary.
- The Judge or Arbitrator can assume direct personal control of the evidence display. This capacity very effectively supports Voir-dire discussions.
- The ability to search all documents that comprise the electronic Trial Bundle and other supporting materials including:
- Procedural documents
- Witness Statements
- Transcript
- Pleadings
- Orders and Rulings
- Notices/Filings
- Cited Cases
- Demonstrative Aids
- Aide Memoirs and
- Submissions
A Complete Court Record
Delium generates the most comprehensive record of proceedings of any evidence presentation solution. Delium’s ‘Record Activity’ module captures and timestamps all critical events of the trial.
These include:
- Witness affirmations and oaths
- Witness examinations, cross-examinations and re-examinations
- Opening and Closing Statements
- Voir Dire
- In camera discussions, and
- Delivery of judgment or arbitral determination
At every step the relevant participants names and legal role is also captured.

Intuitive Interface
Delium’s intuitive interface design replicates the way litigators think and work and caters for a range of technical abilities. Users do not require extensive training to analyse documents, prepare for hearings, and present evidence. Delium is easy to set up and suitable for cases of all sizes.
When Delium displays a document, recipients get the whole document. They can move back and forth between pages, zoom, rotate or annotate, all without impacting the other participants in the room from a single seamless interface.
Delium Publication places a discrete, complete copy of the evidence in the hands of each participant in the proceedings, open at the point of current interest. Once evidence is received, a recipient can manipulate the item as they would a paper copy of the evidence handed to them.
Delium allows authorised users to publish evidence to other selected participants during a hearing without impacting the witness’s view. This feature replicates the traditional process of hearing participants handing paper documents between team members to review.
Delium Vs
Other Solutions
Other courtroom solutions are not comparable with Delium. Delium delivers so much more through its patent-protected functionality. So how does Delium differ from other solutions? The design of Delium:
Supports and replicates traditional courtroom relationships and workflows.
Supports the ability to display private editions of evidence alongside the generic published version and write private analysis to physically secure and logically discrete databases from a single hearing interface.
Supports both hearing room and pre and post-hearing activities from a single User interface.
Supports physically remote users active participation in proceedings.
Provides flexibility so that any Courtroom participant drive evidence publication
Supports the automatic generation of a comprehensive Court Record as a by-product of the ordinary course of proceedings.
Delium understands you need more in a hearing than just the evidence. So Delium can be your virtual trolley, securely carrying everything you might wish to have with you. Your hearing case can include procedural documents, witness statements, experts reports, transcripts, aide memoirs, demonstrative aids, counsels notes, court rules, cited cases, submissions and other relevant documents.
For those who do not want to touch keyboard and mouse – That’s OK just watch the evidence as it is presented. On the other hand, if you wish interactively with evidence (most of us do these days) you
Regardless of your location, with a Delium logon and internet connection, you can participate in virtual or hybrid hearings conducted anywhere in the world. As a result, you can be confident that you are viewing the same evidence simultaneously as the witness and other participants.
Delium provides easy access to the work product applied to evidence during hearing preparation activities without the need to run multiple software platforms. Delium simultaneously publishes evidence in both Public and Private Modes. Witnesses view the Public version of the evidence. Other authorised Users can elect to view a Private version of the evidence that displays any annotations or analysis already made by the User during trial preparation activities. When in Private Mode, authorised Users can continue to annotate and comment on the evidence, confident their work remains private to them and their team.
Delium has been designed to replicate the way litigators think and work, without the need for extensive training.

Handing Not Just Showing
First generation evidence presentation technologies easily and speedily show the relevant part of a document but do not support viewing the whole document in the context in which the particular passage appears..
Delium puts the whole document in ‘your hands’ so you can page forward and back, zoom, rotate, compare, annotate and analyse the whole document not just a particular passage.
Without making individual and duplicative effort to
read and get the “feel” of the whole document, part of its true significance
may be lost by viewing only that part of the document which Counsel asks one
to read.

Private Evidence

Comprehensive Court Record
Delium generates a comprehensive Record, as a by-product of the normal course of proceedings. Exhibit numbers can be assigned automatically or manually as soon as evidence is tendered.
Delium not only identifies the documents shown to each Witness (time stamped), but records the specific page and any zooming, marking or highlighting of particular elements during examination. This record is available to all authorised users at any time.
Publication Lists
Witness examination and submission document lists can be securely prepared in advance, without disclosure to the opposing party. This ensures the required evidence is immediately available to be presented without the need for search while the trial is underway.
